The "GLOBAL HEALTH HUB GERMANY" service refers to the services and applications described below provided by the technical operator of the service, ascrion GmbH, and the content operator, Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH

General terms and conditions for the use of the "GLOBAL HEALTH HUB GERMANY" service
The "GLOBAL HEALTH HUB GERMANY" service is provided via the website https://www.globalhealthhub.de on the Internet as well as under various subdomains and aliases of these domains and via mobile applications (so-called "apps"), background applications, web services and integrations into third-party sites (e.g. via iFrame). All websites, subdomains, aliases, mobile applications, background applications, web services and integrations into third-party sites offered by "GLOBAL HEALTH HUB GERMANY" on which "GLOBAL HEALTH HUB GERMANY" is available are hereinafter collectively referred to as "GLOBAL HEALTH HUB GERMA-NY" websites".
The applications of the "GLOBAL HEALTH HUB GERMANY" service include in particular contact and communication forums (hereinafter "social network") for which the user can register.
These General Terms and Conditions for the use of the "GLOBAL HEALTH HUB GERMANY" service govern the contractual relationship between the User and "GLOBAL HEALTH HUB GERMANY", irrespective of which of the "GLOBAL HEALTH HUB GERMANY" websites the User uses to access the services of "GLOBAL HEALTH HUB GERMANY".

With regard to the use of individual applications, additional terms and conditions may apply in addition to these General Terms and Conditions for the use of the "GLOBAL HEALTH HUB GERMANY" service. In the event of a conflict, the provisions of the additional terms and conditions for the use of the respective application shall take precedence over these General Terms and Conditions for the Use of the "GLOBAL HEALTH HUB GERMANY" Service, unless this precedence is excluded in the additional terms and conditions for the use of the respective application.
The General Terms and Conditions for the use of the "GLOBAL HEALTH HUB GERMANY" service and any additional terms and conditions for the use of individual applications are hereinafter referred to collectively as the "GTC".
The contract is concluded with the Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH, which has commissioned ascrion GmbH with the technical implementation.

 
1 Subject matter of the contract and basis for the use of the "GLOBAL HEALTH HUB GERMANY"
General
1.1 "GLOBAL HEALTH HUB GERMANY" is a service whose purpose is to contribute to the transformation of the healthcare sector by offering various applications. "GLOBAL HEALTH HUB GERMANY" is a specific social network that connects the actors, their activities and projects online and in real life, thus initiating a direct exchange of experience and knowledge. This promotes the rapid and widespread identification, implementation and dissemination of innovative project ideas, initiatives and events. The appealing presentation and intelligent networking of the players improves their cooperation and increases the quality of the projects. This helps to sustainably strengthen the global healthcare sector.
1.2 In view of the increasingly blurred boundaries between work and private life and the interactions between the two, "GLOBAL HEALTH HUB GERMANY" does not focus exclusively on the professional context, but also includes applications in the private context.
1.3 In particular, the "GLOBAL HEALTH HUB GERMANY" aims to open up new possibilities for users to present their activities (e.g. projects, programs, events, group activities...), facilitate networking, promote the exchange of information, support lifelong learning and simplify collaboration and the formation of cooperations. In order to fulfill these purposes, "GLOBAL HEALTH HUB GERMANY" provides the user with certain information, offers, recommendations and services based on collected data, among other things, and promotes interaction - both within and outside the user's network. This is done in accordance with any privacy settings and declarations of consent of the user.
1.4 The social network is the core application of the "GLOBAL HEALTH HUB GERMA-NY" service. The profile page created by the user within the social network (hereinafter referred to as "user profile") represents the identity with which the user appears and is presented within the "GLOBAL HEALTH HUB GERMANY" service, on the "GLOBAL HEALTH HUB GERMANY" websites and in the applications of the service. In principle, registration and the associated creation of a user profile is required for the full use of all functions of "GLOBAL HEALTH HUB GERMANY". Only individual applications of the "GLOBAL HEALTH HUB GERMANY" service can be used for which no registration is required, such as participating as an invited person in an online meeting via the e-conference center or viewing information provided prior to registration.
Social network
1.5 The social network offers the user various possibilities to present himself with his own user profile and with his activities on the "GLOBAL HEALTH HUB GERMANY" websites and outside and to interact with other users and third parties in real time. The full effect of the social network can only be achieved if interesting content can also be accessed by non-users and can be found in search engines, which is why external accessibility and findability is preset for various content. Secret pages and events are excluded from this regulation. These are only displayed to the group of people invited by the administrator of a page/event. All other areas such as the user profile, news feed, groups, users, videos, photos, queries, advanced search, discussion forum and the e-conference center can only be viewed after registration. The user profile and the content created with it can be deleted by the user at any time. The deletion of content by the user is irrevocable.
1.6 The use of "GLOBAL HEALTH HUB GERMANY" is free of charge for all users.

2. conditions of use, conclusion of contract and assurances upon conclusion of contract
General
2.1 A user account is created upon registration on the "GLOBAL HEALTH HUB GERMANY" Website. Without a user account, interaction with other "GLOBAL HEALTH HUB GERMANY" users is excluded. By registering, i.e. entering first name, surname, e-mail address, password and agreeing to the GTC and the data protection provisions, the contract for the use of "GLOBAL HEALTH HUB GERMANY" is concluded between the User and "GLOBAL HEALTH HUB GERMANY".
2.2 The opportunity to use the applications offered on the "GLOBAL HEALTH HUB GERMANY" websites does not constitute an offer, but only an invitation to submit an offer. By completing the booking process, the User submits an offer to conclude a contract for the use of the corresponding "GLOBAL HEALTH HUB GERMANY" application. "GLOBAL HEALTH HUB GERMANY" accepts this offer from the User by providing the relevant services. The contract between the User and "GLOBAL HEALTH HUB GERMANY" shall only come into effect upon this acceptance. "GLOBAL HEALTH HUB GERMANY" is not obliged to conclude a contract.
2.3 The User warrants that all data provided by him/her is true and complete. The User is obliged to keep the data regarding all applications used by him true and complete for the entire term of the contract.
2.4 The user warrants that he/she is of legal age. In the event that the User acts on behalf of a legal entity within the scope of certain Applications, the User warrants that he/she is authorized to act on behalf of the legal entity. Upon request, the User shall provide "GLOBAL HEALTH HUB GERMANY" with evidence of the information warranted in accordance with this clause.
2.5 "GLOBAL HEALTH HUB GERMANY" cannot technically determine with certainty whether a User registered on the "GLOBAL HEALTH HUB GERMANY" Websites is in fact the person that the User claims to be. "GLOBAL HEALTH HUB GERMANY" therefore provides no guarantee for the actual identity of a user.
Social Network
2.6 In order to acquire a "GLOBAL HEALTH HUB GERMANY" membership, registration is required, during which the User must choose a password, among other things.
2.7 The User is obliged to keep the password chosen by him/her secret. "GLOBAL HEALTH HUB GERMANY" will not disclose the password to third parties, will only use it for the registration process and will not ask the User for the password at any time apart from the registration process. For security reasons and to prevent misuse, the user is advised to change his/her password at regular intervals. The User is solely responsible for securing and storing the access data to the "GLOBAL HEALTH HUB GERMANY" member account (in particular the password).
2.8 Each user may only create one user profile. The user should not allow third parties to use their own user profile.

3. right of withdrawal for consumers
Players can cancel their contract at any time by deleting their user account. No written form is required.

4. general obligations of the user and special provisions for the use of the social network
The user is obliged
4.1 to provide only true and non-misleading information and to use his/her real name and not pseudonyms or pseudonyms;
4.2 to only use a photo in the user profile within the social network in which the user is clearly recognizable. The user shall ensure that the public reproduction of the profile photo submitted by him/her on the "GLOBAL HEALTH HUB GERMANY" websites is permitted under applicable law. The use of photos or images of other or non-existent persons or other beings (animals, fantasy creatures, etc.) or logos as profile pictures is not permitted.
4.3 to comply with applicable law and all third-party rights when using "GLOBAL HEALTH HUB GERMANY" and the content on the "GLOBAL HEALTH HUB GERMANY" websites. In particular, the user is prohibited from the following
a) Using offensive or defamatory content, regardless of whether this content concerns other users, "GLOBAL HEALTH HUB GERMANY" employees or other persons or companies;
b) the use of pornographic, violent, abusive, immoral content or content that violates youth protection laws or the advertising, offering and/or distribution of goods or services that are pornographic, violent, abusive, immoral or violate youth protection laws;
c) unreasonable harassment of other users, in particular through spam (cf. Section 7 of the Unfair Competition Act - UWG);
d) using content protected by law (e.g. by copyright, trademark, patent, design or utility model law) without being authorized to do so, or advertising, offering and/or selling goods or services protected by law, also without being authorized to do so; or
e) engaging in or promoting anti-competitive activities, including progressive solicitation (such as chain, snowball or pyramid schemes);
4.4 to refrain from the following harassing activities, even if they do not specifically violate any laws:
(a) Sending chain letters;
b) carrying out, advertising and promoting structural sales measures (such as multi-level marketing or multi-level network marketing); and
c) engaging in salacious or sexually oriented communication (explicit or implicit).
4.5 Users are prohibited from the following actions:
(a) using mechanisms, software or scripts in connection with the use of the "GLOBAL HEALTH HUB GERMANY" Websites. The direct or indirect advertising or distribution of such mechanisms, software or scripts is also prohibited. However, the user may use, advertise or distribute interfaces or software authorized by "GLOBAL HEALTH HUB GERMANY";
b) Blocking, overwriting, modifying, copying, unless this is necessary for the proper use of "GLOBAL HEALTH HUB GERMANY";
c) distributing and publicly reproducing content from the "GLOBAL HEALTH HUB GER-MANY" websites or from other users, unless such distribution and public reproduction is intended within the scope of the respective "GLOBAL HEALTH HUB GERMANY" application or the other user has consented to the distribution and public reproduction; and/or
d) any action that is likely to impair the functionality of the "GLOBAL HEALTH HUB GERMANY" infrastructure, in particular to place an excessive load on it.
e) "GLOBAL HEALTH HUB GERMANY" shall not be obliged to make data and/or information provided by the User available to other Users if such data and/or information is not in accordance with clauses 4.1 and 4.2. "GLO-BAL HEALTH HUB GERMANY" shall be entitled to remove from the "GLOBAL HEALTH HUB GERMANY" Websites any data and/or information not permitted under clauses 4.1 and 4.2 without prior notice to the User.

5. changes to the services and GTC
Changes to the services
5.1 "GLOBAL HEALTH HUB GERMANY" reserves the right to change the services offered on the "GLOBAL HEALTH HUB GER-MANY" Websites or to offer different services, unless this is unreasonable for the User.
5.2 "GLOBAL HEALTH HUB GERMANY" also reserves the right to change the services offered on the "GLOBAL HEALTH HUB GERMANY" Websites or to offer different services,
a) insofar as "GLOBAL HEALTH HUB GERMANY" is obliged to ensure that the services offered by 
"GLOBAL HEALTH HUB GERMANY" with the law applicable to the services, in particular if the applicable legal situation changes;
b) insofar as "GLOBAL HEALTH HUB GERMANY" thereby complies with a court judgment or an official decision directed against "GLOBAL HEALTH HUB GERMANY";
c) insofar as the respective change is necessary to close existing security gaps
d) if the change is only beneficial to the user; or
e) if the change is of a purely technical or procedural nature with no significant impact on the user.
5.3 Changes with only an insignificant impact on the functions of "GLOBAL HEALTH HUB GERMANY" do not constitute changes to services within the meaning of this clause. This applies in particular to changes of a purely graphical nature and mere changes to the arrangement of functions.
Changes to the GTC
5.4 "GLOBAL HEALTH HUB GERMANY" reserves the right to amend these GTC at any time without stating reasons, unless this is unreasonable for the User. "GLOBAL HEALTH HUB GERMANY" shall notify the User of any changes to the GTC in good time. If the User does not object to the validity of the new GTC within six (6) weeks of notification, the amended GTC shall be deemed to have been accepted by the User. "GLOBAL HEALTH HUB GERMANY" shall inform the User in the notification of its right to object and the significance of the objection period.
5.5 "GLOBAL HEALTH HUB GERMANY" also reserves the right to amend the GTC,
a) if the change is only beneficial to the User;
b) if the change is purely technical or procedural, unless it has a significant impact on the User;
c) insofar as "GLOBAL HEALTH HUB GERMANY" is obliged to bring the GTC into compliance with applicable law, in particular if the applicable legal situation changes;
d) to the extent that "GLOBAL HEALTH HUB GERMANY" thereby complies with a court judgment or administrative decision directed against "GLOBAL HEALTH HUB GERMANY"; or
e) to the extent that "GLOBAL HEALTH HUB GERMANY" introduces additional, entirely new services, services or service elements that require a service description in the GTC, unless the existing user relationship is adversely changed as a result.
5.6 "GLOBAL HEALTH HUB GERMANY" will provide information about such changes to the GTC, for example on the "GLOBAL HEALTH HUB GERMANY" Websites.

6 Term, termination of the contract, sanctions, repayment of fees paid in advance
General
6.1 If there are no special provisions on the term and termination of individual applications or "GLOBAL HEALTH HUB GERMANY" memberships in individual cases, the contractual relationship may be terminated by either party at any time.
Membership free of charge
6.2 The User and "GLOBAL HEALTH HUB GERMANY" may terminate the free membership at any time without giving reasons.
6.3 Even if there are special provisions regarding the term and termination, both parties have the right to terminate the contractual relationship for good cause at any time without notice. Good cause for extraordinary termination exists if the continuation of the contractual relationship until the expiry of the statutory notice period is not reasonable for the terminating party, taking into account all circumstances of the individual case and weighing the interests of both parties. Important reasons for "GLOBAL HEALTH HUB GERMANY" are in particular the following events:
a) Non-compliance with legal regulations by the User;
b) breach of contractual obligations by the User;
c) the reputation of the services offered on the "GLOBAL HEALTH HUB GERMANY" websites is significantly impaired by the presence of the user (e.g. if, after re-registration of the user, it transpires that the user has been convicted of an intentional criminal offense and other users are aware of this conviction);
d) the user promotes associations or communities - or their methods or activities - that are being monitored by security or youth protection authorities;
e) the user harms one or more other users; or
f) the user is a member of a sect or a religious community that is controversial in Germany.
6.4 In the event of good cause in accordance with clause 6, "GLOBAL HEALTH HUB GERMANY" may impose the following sanctions on the User irrespective of termination:
(a) deletion of content posted by the User;
b) blocking access to the service of the "GLOBAL HEALTH HUB GERMANY" websites or individual applications; or
c) issuing a warning.

7 Responsibility for user content, data and/or information, availability
7.1 "GLOBAL HEALTH HUB GERMANY" accepts no responsibility for the content, data and/or information provided by users of the "GLOBAL HEALTH HUB GERMANY" Websites or for content on linked external websites. In particular, "GLOBAL HEALTH HUB GERMANY" does not warrant that such content is true, fulfills a specific purpose or can serve such a purpose.
7.2 If the User becomes aware of any use of the "GLOBAL HEALTH HUB GERMANY" Websites (including the use of pseudonyms or deceptive identities) in breach of the law or the Contract, the User may report such use.
7.3 "GLOBAL HEALTH HUB GERMANY" is under no obligation to prevent such storage by third parties in respect of data or content that is or was publicly available in accordance with the GTC, the privacy policy of "GLOBAL HEALTH HUB GERMANY" or the User's settings.
7.4 "GLOBAL HEALTH HUB GERMANY" merely offers the User a platform and does not participate in the content of communication between Users. This does not apply if "GLOBAL HEALTH HUB GERMANY" moderates a group itself in individual cases. If Users conclude contracts with each other via the "GLOBAL HEALTH HUB GERMANY" Websites, "GLOBAL HEALTH HUB GERMANY" is not involved in this and therefore does not become a contractual partner. The users are solely responsible for the execution and fulfillment of the contracts concluded between them. "GLOBAL HEALTH HUB GERMANY" shall not be liable for breaches of duty by the Users arising from the contracts concluded between the Users.
7.5 The User acknowledges that 100% availability of the "GLOBAL HEALTH HUB GERMANY" Websites is technically impossible. However, "GLOBAL HEALTH HUB GERMANY" shall endeavor to keep the "GLOBAL HEALTH HUB GERMANY" Websites available as constantly as possible. In particular, maintenance, security or capacity issues and events beyond the control of "GLOBAL HEALTH HUB GERMANY" (such as disruptions to public communications networks, power failures, etc.) may lead to disruptions or temporary suspension of the service on the "GLOBAL HEALTH HUB GERMANY" websites.

8 Liability of "GLOBAL HEALTH HUB GERMANY"
8.1 In the event of a breach of material contractual obligations caused by slight negligence, the liability of 
"GLOBAL HEALTH HUB GERMANY" shall be liable in an amount limited to the foreseeable damage typical for the contract. Material contractual obligations are those obligations whose fulfillment is essential for the proper performance of a contract and on whose compliance the contracting parties may regularly rely. Any further liability of "GLOBAL HEALTH HUB GERMANY" is excluded.
8.2 Liability under the Product Liability Act remains unaffected.

9 Applicable law, place of jurisdiction and other matters
9.1 "GLOBAL HEALTH HUB GERMANY" may use subcontractors. "GLOBAL HEALTH HUB GERMANY shall remain responsible for the performance of the obligations assumed by GLOBAL HEALTH HUB GERMANY even if subcontractors are engaged.
9.2 "GLOBAL HEALTH HUB GERMANY" shall be entitled to transfer rights and obligations in whole or in part to third parties.
9.3 "GLOBAL HEALTH HUB GERMANY" may send declarations to the User by email or letter, unless otherwise provided for in the GTC. In addition, "GLOBAL HEALTH HUB GERMANY" may make declarations to the User by sending a message to the User's private "GLOBAL HEALTH HUB GERMANY" mailbox, which is part of the User's "GLOBAL HEALTH HUB GERMANY" membership.
9.4 We do not participate in dispute resolution proceedings before a consumer arbitration board.
9.5 The place of performance is the registered office of ascrion GmbH.
9.6 The place of jurisdiction for merchants within the meaning of the German Commercial Code (HGB) is the registered office of ascrion GmbH.
9.7 German law shall apply to the exclusion of international private law and the UN Convention on Contracts for the International Sale of Goods, which has been incorporated into German law.

10 Technical features of the "GLOBAL HEALTH HUB GERMANY" websites
10.1 Infrastructure: The "GLOBAL HEALTH HUB GERMANY" websites are operated on the basis of the certified hosting provider Servado (https://www.servado.de) within Germany.
10.2 System availability: The "GLOBAL HEALTH HUB GERMANY" websites are generally available 24 hours a day. Outside core hours, however, availability may be limited due to maintenance work.
10.3 Core time: Core time is the time from 05:00 to 20:00 (CET/CEST) on working days (Monday - Friday). In individual cases and with prior notice, maintenance work may also be carried out during core hours.
10.4 Maintenance and maintenance times: Maintenance work is generally carried out between 00:00 and 02:00 on working days or between 18:00 and 22:00 on Sundays and public holidays. In the event of maintenance work outside these maintenance times, the customer shall be informed of the time, duration and scope of the work in good time, if possible 10 days in advance.
10.5 Security: The "GLOBAL HEALTH HUB GERMANY" websites use state-of-the-art SSL encryption based on a trusted public certificate for data encryption of communication. All technical components of the "GLOBAL HEALTH HUB GERMANY" websites are located on secure servers of trustworthy providers within the EU. Separate firewalls secure all relevant components on the servers. The distribution to different providers and servers and an associated backup strategy ensures maximum data security.

11. additional conditions for the use of the "GLOBAL HEALTH HUB GERMANY" e-conference center
11.1 The e-conference center supplements the communication offer of the social network "GLOBAL HEALTH HUB GERMANY" with freely bookable online meeting rooms. Registered "GLOBAL HEALTH HUB GERMANY" users can organize and hold presentations (webinars), training sessions or project meetings in the e-conference center at any time. The participants of an online meeting do not have to be registered on the "GLOBAL HEALTH HUB GERMANY". Only the initiator/organizer of the online meeting must be registered on the "GLOBAL HEALTH HUB GERMANY".
11.2 The online meeting rooms are provided free of charge for all participants. Use of the rooms is subject to the condition that priority is given to topics related to the health sector.
11.3 "GLOBAL HEALTH HUB GERMANY" reserves the right to block access to the e-Conference Center for the relevant User in the event of clear abuse of the Terms of Use.
11.4 Furthermore, "GLOBAL HEALTH HUB GERMANY" reserves the right to reduce the number of online meeting rooms available at any time. The aforementioned changes are subject to the deadlines set out in section 5 and will be communicated to the User in good time.
11.5 These additional terms and conditions for the use of the e-conference center supplement the general terms and conditions for the use of the "GLOBAL HEALTH HUB GERMANY" service.
11.6 In all other respects, the provisions of the General Terms and Conditions for the Use of the "GLOBAL HEALTH HUB GERMANY" Service shall apply.

Der Dienst „GLOBAL HEALTH HUB GERMANY“ wird über die Websites https://www.globalhealthhub.de  im Internet sowie unter verschiedenen Subdomains und Aliases dieser Domains und über mobile Applikationen (sogenannte "Apps"), Hintergrund-Applikationen, Webservices und Einbindungen in Drittseiten (z. B. per iFrame) erbracht. Alle von „GLOBAL HEALTH HUB GERMANY“ angebotenen Websites, Subdomains, Aliases, mobile Applikationen, Hintergrund-Applikationen, Webservices und Einbindungen in Drittseiten, auf denen „GLOBAL HEALTH HUB GERMANY“ zur Verfügung steht, werden im Folgenden insgesamt „GLOBAL HEALTH HUB GERMANY“ Websites" genannt.

Zu den Anwendungen des Dienstes „GLOBAL HEALTH HUB GERMANY“ gehören insbesondere Kontakt- und Kommunikationsforen (im Folgenden "soziales Netzwerk"), für die/der Nutzer:in sich anmelden kann.

Diese Allgemeinen Bedingungen für die Nutzung des Dienstes „GLOBAL HEALTH HUB GERMANY“ regeln das Vertragsverhältnis zwischen dem Nutzer und „GLOBAL HEALTH HUB GERMANY“, unabhängig davon, über welche der „GLOBAL HEALTH HUB GERMANY“ Websites der Nutzer Leistungen von „GLOBAL HEALTH HUB GERMANY“ in Anspruch nimmt.

Hinsichtlich der Nutzung einzelner Anwendungen gelten ergänzend zu diesen Allgemeinen Bedingungen für die Nutzung des Dienstes „GLOBAL HEALTH HUB GERMANY“ gegebenenfalls zusätzliche Bedingungen. Im Fall eines Widerspruchs geht die Regelung der zusätzlichen Bedingungen für die Nutzung der jeweiligen Anwendung diesen Allgemeinen Bedingungen für die Nutzung des Dienstes „GLOBAL HEALTH HUB GERMANY“ vor, sofern dieser Vorrang nicht in den zusätzlichen Bedingungen für die Nutzung der jeweiligen Anwendung ausgeschlossen ist.

Die Allgemeinen Bedingungen für die Nutzung des Dienstes „GLOBAL HEALTH HUB GERMANY“ und etwaige zusätzliche Bedingungen für die Nutzung einzelner Anwendungen werden im Folgenden insgesamt "AGB" genannt.

Der Vertragsschluss erfolgt mit der Deutschen Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH, welche die ascrion GmbH mit der technischen Durchführung beauftragt hat.

• „GLOBAL HEALTH HUB GERMANY“ ist ein Dienst, der den Zweck verfolgt, durch das Angebot unterschiedlicher Anwendungen zur Transformation des Gesundheitssektors beizutragen. „GLOBAL HEALTH HUB GERMANY“ sind ein spezifisches soziales Netzwerk, mit dem die Akteure, deren Aktivitäten und Projekte online und real vernetzt werden und so ein direkter Erfahrungs- und Wissensaustausch initiiert wird. Dies fördert die schnelle und flächendeckende Identifikation, Umsetzung und Verbreitung von innovativen Projektideen, Initiativen und Veranstaltungen. Die ansprechende Darstellung sowie die intelligente Vernetzung der Akteure verbessert deren Zusammenarbeit und steigert die Qualität der Projekte. Dies trägt dazu bei, den weltweiten Gesundheitssektor nachhaltig zu stärken.
• Angesichts des zunehmenden Verschwimmens der Grenzen zwischen Arbeits- und Privatleben und der Wechselwirkungen zwischen beiden, konzentriert sich „GLOBAL HEALTH HUB GERMANY“ dabei nicht ausschließlich auf den professionellen Kontext, sondern bezieht auch Anwendungen im privaten Kontext mit ein.
• Insbesondere möchte die „GLOBAL HEALTH HUB GERMANY“ dem Nutzer neue Möglichkeiten der Darstellung ihrer Tätigkeiten (z.B. Projekte, Programme, Veranstaltungen, Gruppenaktivitäten…) eröffnen, ihm erleichtern Netzwerke zu bilden, den Informationsaustausch fördern, lebenslanges Lernen unterstützen und die Zusammenarbeit sowie die Bildung von Kooperationen vereinfachen. Um diese Zwecke zu erfüllen, stellt „GLOBAL HEALTH HUB GERMANY“ dem Nutzer unter anderem auf Basis erhobener Daten bestimmte Informationen, Angebote, Empfehlungen sowie Dienstleistungen bereit und fördert die Interaktion – innerhalb und außerhalb des Netzwerks des Nutzers. Dies erfolgt entsprechend etwaiger Privatsphäre-Einstellungen und Einwilligungserklärungen des Nutzers.
• Das soziale Netzwerk ist die Kernanwendung des Dienstes „GLOBAL HEALTH HUB GERMANY“. Die im Rahmen des sozialen Netzwerks vom Nutzer erstellte Profilseite (im Folgenden "Nutzerprofil" genannt) stellt die Identität dar, mit der der Nutzer innerhalb des Dienstes „GLOBAL HEALTH HUB GERMANY“, auf den „GLOBAL HEALTH HUB GERMANY“ Websites und in den Anwendungen des Dienstes auftritt und dargestellt wird. Grundsätzlich ist für die vollständige Nutzung aller Funktionen von „GLOBAL HEALTH HUB GERMANY“ die Registrierung und das damit einhergehende Anlegen eines Nutzerprofils erforderlich. Es sind lediglich einzelne Anwendungen des Dienstes „GLOBAL HEALTH HUB GERMANY“ nutzbar, bei denen keine Registrierung erforderlich ist, wie z.B. als eingeladene Person in einem Online-Meeting über das e-Konferenzzentrum teilnehmen oder die Betrachtung von vor der Registrierung bereitgestellten Informationen.

Soziales Netzwerk

• Das soziale Netzwerk bietet dem Nutzer diverse Möglichkeiten, sich mit dem eigenen Nutzerprofil und mit seinen Aktivitäten auf den „GLOBAL HEALTH HUB GERMANY“ Websites und außerhalb zu präsentieren und mit anderen Nutzern und Dritten in Echtzeit zu interagieren. Die volle Wirkung des sozialen Netzwerks kann nur bei Abrufbarkeit interessanter Inhalt auch für Nicht-Nutzer und Auffindbarkeit in Suchmaschinen erreicht werden, weshalb für verschiedene Inhalte externe Abruf- und Auffindbarkeit voreingestellt ist. Ausgenommen von dieser Regelung sind geheime Seiten und Veranstaltungen. Diese werden lediglich den vom Administrator einer Seite/Veranstaltung eingeladenen Personenkreis angezeigt. Sämtliche weitere Bereiche wie das Nutzerprofil, News Feed, Gruppen, Nutzer, Videos, Fotos, Umfragen, Erweiterte Suche, Diskussionsforum und das e-Konferenzzentrum können erst nach der Registrierung eingesehen werden. Das Nutzerprofil und die damit angelegten Inhalte können jederzeit selbstständig durch den Nutzer gelöscht werden. Die Löschung der Inhalte durch den Nutzer ist unwiderruflich.
• Die Nutzung von „GLOBAL HEALTH HUB GERMANY“ ist für alle Nutzer kostenfrei.

Allgemein

• Mit der Registrierung auf der „GLOBAL HEALTH HUB GERMANY“ Webseite wird ein Nutzerkonto erstellt. Ohne ein Nutzerkonto ist die Interaktion mit anderen „GLOBAL HEALTH HUB GERMANY“-Nutzern ausgeschlossen. Durch die Registrierung, d.h. die Eingabe von Vorname, Nachname, E-Mail-Adresse, Passwort und der Zustimmung zu den AGB sowie der Datenschutzbestimmungen kommt der Vertrag zur Nutzung von „GLOBAL HEALTH HUB GERMANY“ zwischen dem Nutzer und „GLOBAL HEALTH HUB GERMANY“ zu Stande.
• Die Möglichkeit zur Nutzung der auf den „GLOBAL HEALTH HUB GERMANY“ Websites angebotenen Anwendungen stellt kein Angebot, sondern nur eine Aufforderung zur Abgabe eines Angebots dar. Durch den Abschluss des Buchungsvorgangs gibt der Nutzer ein Angebot zum Abschluss des Vertrages über die Nutzung der entsprechenden „GLOBAL HEALTH HUB GERMANY“ Anwendung ab. „GLOBAL HEALTH HUB GERMANY“ nimmt dieses Angebot des Nutzers durch Bereitstellung der entsprechenden Dienste an. Erst durch diese Annahme kommt der Vertrag zwischen dem Nutzer und „GLOBAL HEALTH HUB GERMANY“ zustande. „GLOBAL HEALTH HUB GERMANY“ ist nicht zum Vertragsschluss verpflichtet.
• Der Nutzer sichert zu, dass alle von ihm angegebenen Daten wahr und vollständig sind. Der Nutzer ist verpflichtet, die Daten hinsichtlich aller von ihm genutzten Anwendungen während der gesamten Vertragslaufzeit wahr und vollständig zu halten.
• Der Nutzer sichert zu, dass er volljährig ist. Für den Fall, dass der Nutzer in Rahmen bestimmter Anwendungen für eine juristische Person tätig wird, sichert der Nutzer zu, bevollmächtigt zu sein, um im Namen der juristischen Person tätig zu werden. Der Nutzer wird „GLOBAL HEALTH HUB GERMANY“ auf Anfrage die gemäß dieser Ziffer zugesicherten Angaben nachweisen.
• „GLOBAL HEALTH HUB GERMANY“ kann technisch nicht mit Sicherheit feststellen, ob ein auf den „GLOBAL HEALTH HUB GERMANY“ Websites registrierter Nutzer tatsächlich diejenige Person darstellt, die der Nutzer vorgibt zu sein. „GLOBAL HEALTH HUB GERMANY“ leistet daher keine Gewähr für die tatsächliche Identität eines Nutzers.

Soziales Netzwerk

• Für den Erwerb einer „GLOBAL HEALTH HUB GERMANY“ Mitgliedschaft ist eine Registrierung erforderlich, bei der der Nutzer unter anderem ein Passwort wählen muss.
• Der Nutzer ist verpflichtet, das von ihm gewählte Passwort geheim zu halten. „GLOBAL HEALTH HUB GERMANY“ wird das Passwort nicht an Dritte weitergeben, nur für den Anmeldevorgang benutzen und den Nutzer – vom Anmeldevorgang abgesehen – zu keinem Zeitpunkt nach dem Passwort fragen. Aus Sicherheitsgründen und um Missbrauch vorzubeugen wird dem Nutzer empfohlen, sein Passwort in regelmäßigen Abständen zu ändern. Die Sicherung und Aufbewahrung der Zugangsdaten zum „GLOBAL HEALTH HUB GERMANY“ Mitgliedskonto (insbesondere des Passworts) fällt in den ausschließlichen Verantwortungsbereich des Nutzers.
• Jeder Nutzer darf nur ein Nutzerprofil anlegen. Der Nutzer sollte Dritten nicht gestatten, das eigene Nutzerprofil zu nutzen.

3. Widerrufsrecht für Verbraucher

Akteure können Ihren Vertrag jederzeit aufkündigen, indem Sie ihr Nutzerkonto löschen. Es bedarf keiner Schriftform.

1. ausschließlich wahre und nicht irreführende Angaben zu machen sowie seinen Klarnamen und keine Pseudonyme oder Künstlernamen zu verwenden;
2. als Profilbild im Nutzerprofil im Rahmen des sozialen Netzwerks nur ein solches Foto zu verwenden, auf dem der Nutzer klar und deutlich erkennbar ist. Der Nutzer stellt sicher, dass die öffentliche Wiedergabe des von ihm übermittelten Profil-Fotos auf den „GLOBAL HEALTH HUB GERMANY“ Websites nach geltendem Recht erlaubt ist. Die Nutzung von Fotos oder Abbildungen anderer oder nicht existierender Personen oder anderer Wesen (Tiere, Fantasiewesen etc.) oder von Logos als Profilbild ist nicht gestattet.
3. bei der Nutzung von „GLOBAL HEALTH HUB GERMANY“ und der Inhalte auf den „GLOBAL HEALTH HUB GERMANY“ Websites geltendes Recht sowie alle Rechte Dritter zu beachten. Es ist dem Nutzer insbesondere Folgendes untersagt:

• Verwendung beleidigender oder verleumderischer Inhalte, unabhängig davon, ob diese Inhalte andere Nutzer, „GLOBAL HEALTH HUB GERMANY“ Mitarbeiter oder andere Personen oder Unternehmen betreffen;
• Verwendung pornografischer, gewaltverherrlichender, missbräuchlicher, sittenwidriger oder Jugendschutzgesetze verletzende Inhalte oder Bewerbung, Angebot und/oder Vertrieb von pornografischen, gewaltverherrlichenden, missbräuchlichen, sittenwidrigen oder Jugendschutzgesetze verletzende Waren oder Dienstleistungen;
• unzumutbare Belästigungen anderer Nutzer, insbesondere durch Spam (vgl. § 7 Gesetz gegen den unlauteren Wettbewerb – UWG);
• Verwendung von gesetzlich (z. B. durch das Urheber-, Marken-, Patent-, Geschmacksmuster- oder Gebrauchsmusterrecht) geschützten Inhalten, ohne dazu berechtigt zu sein, oder Bewerbung, Angebot und/oder Vertrieb von gesetzlich geschützten Waren oder Dienstleistungen, ebenfalls ohne dazu berechtigt zu sein; oder
• Vornahme oder Förderung wettbewerbswidriger Handlungen, einschließlich progressiver Kundenwerbung (wie Ketten-, Schneeball- oder Pyramidensysteme);

• Versendung von Kettenbriefen;
• Durchführung, Bewerbung und Förderung von Strukturvertriebsmaßnahmen (wie Multi-Level-Marketing oder Multi-Level-Network-Marketing); sowie
• Vornahme von anzüglicher oder sexuell geprägter Kommunikation (explizit oder implizit).
• Folgende Handlungen sind dem Nutzer untersagt:

(a) Verwendung von Mechanismen, Software oder Scripts in Verbindung mit der Nutzung der „GLOBAL HEALTH HUB GERMANY“ Websites. Die direkte oder indirekte Bewerbung oder Verbreitung solcher Mechanismen, Software oder Scripts ist ebenfalls untersagt. Der Nutzer darf jedoch von „GLOBAL HEALTH HUB GERMANY“ autorisierte Schnittstellen oder Software nutzen, bewerben oder verbreiten;

(b) Blockieren, Überschreiben, Modifizieren, Kopieren, soweit dies nicht für die ordnungsgemäße Nutzung von „GLOBAL HEALTH HUB GERMANY“ erforderlich ist;

(c) Verbreitung und öffentliche Wiedergabe von Inhalten der „GLOBAL HEALTH HUB GERMANY“ Websites oder von anderen Nutzern, außer diese Verbreitung und öffentliche Wiedergabe ist im Rahmen der jeweiligen „GLOBAL HEALTH HUB GERMANY“ Anwendung vorgesehen oder der andere Nutzer hat der Verbreitung und öffentlichen Wiedergabe zugestimmt; und/oder

(d) jede Handlung, die geeignet ist, die Funktionalität der „GLOBAL HEALTH HUB GERMANY“ Infrastruktur zu beeinträchtigen, insbesondere diese übermäßig zu belasten.

• „GLOBAL HEALTH HUB GERMANY“ ist nicht verpflichtet, vom Nutzer bereitgestellte Daten und/oder Informationen anderen Nutzern zur Verfügung zu stellen, wenn diese Daten und/oder Informationen nicht im Einklang mit den Ziffern 4.1 und 4.2 stehen. „GLOBAL HEALTH HUB GERMANY“ ist berechtigt, nach den Ziffern 4.1 und 4.2 unzulässige Daten und/oder Informationen ohne Vorankündigung gegenüber dem Nutzer von den „GLOBAL HEALTH HUB GERMANY“ Websites zu entfernen.

Änderungen der Leistungen

• „GLOBAL HEALTH HUB GERMANY“ behält sich vor, die auf den „GLOBAL HEALTH HUB GERMANY“ Websites angebotenen Leistungen zu ändern oder abweichende Leistungen anzubieten, außer dies ist für den Nutzer nicht zumutbar.
• „GLOBAL HEALTH HUB GERMANY“ behält sich darüber hinaus vor, die auf den „GLOBAL HEALTH HUB GERMANY“ Websites angebotenen Leistungen zu ändern oder abweichende Leistungen anzubieten,

(a) soweit „GLOBAL HEALTH HUB GERMANY“ verpflichtet ist, die Übereinstimmung der von „GLOBAL HEALTH HUB GERMANY“ angebotenen Leistungen mit dem auf die Leistungen anwendbaren Recht herzustellen, insbesondere wenn sich die geltende Rechtslage ändert;

(b) soweit „GLOBAL HEALTH HUB GERMANY“ damit einem gegen „GLOBAL HEALTH HUB GERMANY“ gerichteten Gerichtsurteil oder einer Behördenentscheidung nachkommt;

(c) soweit die jeweilige Änderung notwendig ist, um bestehende Sicherheitslücken zu schließen;

(d) wenn die Änderung lediglich vorteilhaft für den Nutzer ist; oder

(e) wenn die Änderung rein technischer oder prozessualer Natur ohne wesentliche Auswirkungen für den Nutzer ist.

• Änderungen mit lediglich unwesentlichem Einfluss auf die Funktionen von „GLOBAL HEALTH HUB GERMANY“ stellen keine Leistungsänderungen im Sinne dieser Ziffer dar. Dies gilt insbesondere für Änderungen rein graphischer Art und die bloße Änderung der Anordnung von Funktionen.

Änderungen der AGB

• „GLOBAL HEALTH HUB GERMANY“ behält sich vor, diese AGB jederzeit ohne Nennung von Gründen zu ändern, es sei denn, das ist für den Nutzer nicht zumutbar. „GLOBAL HEALTH HUB GERMANY“ wird den Nutzer über Änderungen der AGB rechtzeitig benachrichtigen. Widerspricht der Nutzer der Geltung der neuen AGB nicht innerhalb von sechs (6) Wochen nach der Benachrichtigung, gelten die geänderten AGB als vom Nutzer angenommen. „GLOBAL HEALTH HUB GERMANY“ wird den Nutzer in der Benachrichtigung auf sein Widerspruchsrecht und die Bedeutung der Widerspruchsfrist hinweisen.
• „GLOBAL HEALTH HUB GERMANY“ behält sich darüber hinaus vor, AGB zu ändern,

(a) wenn die Änderung lediglich vorteilhaft für den Nutzer ist;

(b) wenn die Änderung rein technisch oder prozessual bedingt ist, es sei denn, sie haben wesentliche Auswirkungen für den Nutzer;

(c) soweit „GLOBAL HEALTH HUB GERMANY“ verpflichtet ist, die Übereinstimmung der AGB mit anwendbarem Recht herzustellen, insbesondere wenn sich die geltende Rechtslage ändert;

(d) soweit „GLOBAL HEALTH HUB GERMANY“ damit einem gegen „GLOBAL HEALTH HUB GERMANY“ gerichteten Gerichtsurteil oder einer Behördenentscheidung nachkommt; oder

(e) soweit „GLOBAL HEALTH HUB GERMANY“ zusätzliche, gänzlich neue Dienstleistungen, Dienste oder Dienstelemente einführt, die einer Leistungsbeschreibung in den AGB bedürfen, es sei denn, dass bisherige Nutzungsverhältnis wird dadurch nachteilig verändert.

„GLOBAL HEALTH HUB GERMANY“ wird über solche Änderungen der AGB informieren, zum Beispiel auf den „GLOBAL HEALTH HUB GERMANY“ Websites.

Allgemein

• Wenn im Einzelfall keine besonderen Bestimmungen zur Laufzeit und Kündigung einzelner Anwendungen oder „GLOBAL HEALTH HUB GERMANY“ Mitgliedschaften entgegenstehen, kann das Vertragsverhältnis von beiden Seiten jederzeit beendet werden.

Unentgeltliche Mitgliedschaft

• Der Nutzer und „GLOBAL HEALTH HUB GERMANY“ können die unentgeltliche Mitgliedschaft jederzeit ohne Angabe von Gründen kündigen.
• Auch bei Vorliegen besonderer Bestimmungen zur Laufzeit und Kündigung haben beide Parteien das Recht, das Vertragsverhältnis bei Vorliegen eines wichtigen Grundes jederzeit ohne Einhaltung einer Frist außerordentlich zu kündigen. Ein wichtiger Grund zur außerordentlichen Kündigung liegt vor, wenn die Fortsetzung des Vertragsverhältnisses bis zum Ablauf der gesetzlichen Kündigungsfrist für die kündigende Partei unter Berücksichtigung aller Umstände des Einzelfalls und unter Abwägung der Interessen beider Parteien nicht zumutbar ist. Wichtige Gründe sind für „GLOBAL HEALTH HUB GERMANY“ insbesondere die folgenden Ereignisse:

(a) Nichteinhaltung gesetzlicher Vorschriften durch den Nutzer;

(b) Verstoß des Nutzers gegen seine vertraglichen Pflichten;

(c) der Ruf der auf den „GLOBAL HEALTH HUB GERMANY“ Websites angebotenen Dienste wird durch die Präsenz des Nutzers erheblich beeinträchtigt (z. B., wenn sich nach Registrierung des Nutzers herausstellt, dass der Nutzer wegen einer vorsätzlichen Straftat rechtskräftig verurteilt ist und anderen Nutzern diese Verurteilung bekannt ist);

(d) der Nutzer wirbt für Vereinigungen oder Gemeinschaften – oder deren Methoden oder Aktivitäten –, die von Sicherheits- oder Jugendschutzbehörden beobachtet werden;

(e) der Nutzer schädigt einen oder mehrere andere Nutzer; oder

(f) der Nutzer ist Mitglied einer Sekte oder einer in Deutschland umstrittenen Glaubensgemeinschaft.

• Bei Vorliegen eines wichtigen Grundes nach Ziffer 6.3 kann „GLOBAL HEALTH HUB GERMANY“ unabhängig von einer Kündigung nach Ziffer 6.4 auch die folgenden Sanktionen gegen den Nutzer verhängen:

(a) Löschung von Inhalten, die der Nutzer eingestellt hat;

(b) Sperrung des Zugangs zum Dienst der „GLOBAL HEALTH HUB GERMANY“ Websites oder einzelner Anwendungen; oder

(c) Ausspruch einer Abmahnung.

• • „GLOBAL HEALTH HUB GERMANY“ übernimmt keine Verantwortung für die von den Nutzern der „GLOBAL HEALTH HUB GERMANY“ Websites bereitgestellten Inhalte, Daten und/oder Informationen sowie für Inhalte auf verlinkten externen Websites. „GLOBAL HEALTH HUB GERMANY“ gewährleistet insbesondere nicht, dass diese Inhalte wahr sind, einen bestimmten Zweck erfüllen oder einem solchen Zweck dienen können.
  • Soweit der Nutzer eine gesetzes- oder vertragswidrige Benutzung der „GLOBAL HEALTH HUB GERMANY“ Websites (einschließlich der Verwendung von Pseudonymen oder täuschenden Identitäten) bemerkt, kann er diese melden.
  • Hinsichtlich Daten oder Inhalten, die gemäß den AGB, den Datenschutzbestimmungen von „GLOBAL HEALTH HUB GERMANY“ oder den Einstellungen des Nutzers öffentlich verfügbar sind oder waren und durch einen Dritten gespeichert wurden, trifft „GLOBAL HEALTH HUB GERMANY“ keine Pflicht zur Unterbindung einer solchen Speicherung beim Dritten.
  • „GLOBAL HEALTH HUB GERMANY“ bietet dem Nutzer lediglich eine Plattform an und beteiligt sich grundsätzlich nicht inhaltlich an der Kommunikation der Nutzer untereinander. Dies gilt nicht, soweit „GLOBAL HEALTH HUB GERMANY“ im Einzelfall die Moderation einer Gruppe selbst durchführt. Sofern die Nutzer über die „GLOBAL HEALTH HUB GERMANY“ Websites Verträge untereinander schließen, ist „GLOBAL HEALTH HUB GERMANY“ hieran nicht beteiligt und wird daher kein Vertragspartner. Die Nutzer sind für die Abwicklung und die Erfüllung der untereinander geschlossenen Verträge allein verantwortlich. „GLOBAL HEALTH HUB GERMANY“ haftet nicht für Pflichtverletzungen der Nutzer aus den zwischen den Nutzern geschlossenen Verträgen.
  • Der Nutzer erkennt an, dass eine 100%ige Verfügbarkeit der „GLOBAL HEALTH HUB GERMANY“ Websites technisch nicht zu realisieren ist. „GLOBAL HEALTH HUB GERMANY“ bemüht sich jedoch, die „GLOBAL HEALTH HUB GERMANY“ Websites möglichst konstant verfügbar zu halten. Insbesondere Wartungs-, Sicherheits- oder Kapazitätsbelange sowie Ereignisse, die nicht im Machtbereich von „GLOBAL HEALTH HUB GERMANY“ stehen (wie z. B. Störungen von öffentlichen Kommunikationsnetzen, Stromausfälle etc.), können zu Störungen oder zur vorübergehenden Einstellung des Dienstes auf den „GLOBAL HEALTH HUB GERMANY“ Websites führen.

• • Bei der leicht fahrlässig verursachten Verletzung wesentlicher Vertragspflichten haftet „GLOBAL HEALTH HUB GERMANY“ außer im der Ziffer 8.2 der Höhe nach begrenzt auf den vertragstypisch vorhersehbaren Schaden. Wesentliche Vertragspflichten sind abstrakt solche Pflichten, deren Erfüllung die ordnungsgemäße Durchführung eines Vertrages überhaupt erst ermöglicht und auf deren Einhaltung die Vertragsparteien regelmäßig vertrauen dürfen. Im Übrigen ist eine Haftung von „GLOBAL HEALTH HUB GERMANY“ ausgeschlossen.
  • Die Haftung nach dem Produkthaftungsgesetz bleibt unberührt.

• • „GLOBAL HEALTH HUB GERMANY“ kann Unterauftragnehmer einsetzen. „GLOBAL HEALTH HUB GERMANY“ bleibt auch bei Einsetzung von Unterauftragnehmern verantwortlich für die Erfüllung der durch „GLOBAL HEALTH HUB GERMANY“ übernommen Pflichten.
  • „GLOBAL HEALTH HUB GERMANY“ ist berechtigt, Rechte und Pflichten ganz oder teilweise an Dritte zu übertragen.
  • „GLOBAL HEALTH HUB GERMANY“ kann Erklärungen gegenüber dem Nutzer per E-Mail, oder Brief übermitteln, sofern in den AGB nicht anders geregelt. Außerdem kann „GLOBAL HEALTH HUB GERMANY“ Erklärungen gegenüber dem Nutzer per Mitteilung in das private „GLOBAL HEALTH HUB GERMANY“ Postfach des Nutzers, das Bestandteil der „GLOBAL HEALTH HUB GERMANY“ Mitgliedschaft des Nutzers ist, abgeben.
  • Wir nehmen nicht an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teil.
  • Erfüllungsort ist der Sitz der ascrion GmbH.
  • Gerichtsstand für Kaufleute im Sinne des Handelsgesetzbuches (HGB) ist der Sitz der ascrion GmbH.
  • Es gilt deutsches Recht unter Ausschluss des internationalen Privatrechts und des ins deutsche Recht übernommenen UN-Kaufrechts.
    

1. • Infrastruktur: Der Betrieb der „GLOBAL HEALTH HUB GERMANY“ Websites erfolgt auf Basis des zertifizierten Hostinganbieters Servado (https://www.servado.de) innerhalb Deutschlands.
   • Systemverfügbarkeit: Die „GLOBAL HEALTH HUB GERMANY“ Websites stehen in der Regel täglich 24 Stunden zur Verfügung. Außerhalb der Kernzeit kann die Verfügbarkeit jedoch bedingt durch Wartungsarbeiten eingeschränkt sein.
   • Kernzeit: Kernzeit ist die Zeit von 05:00 Uhr bis 20:00 Uhr (CET/CEST) an Werktagen (Montag – Freitag). In Einzelfällen und nach rechtzeitiger vorheriger Ankündigung kann es auch innerhalb der Kernzeit zu Wartungsarbeiten kommen.
   • Wartung und Wartungszeiten: Wartungen werden in der Regel zwischen 00:00 Uhr und 02:00 Uhr an Werktagen oder an Sonn- und Feiertragen in der Zeit zwischen 18:00 Uhr und 22.00 Uhr vorgenommen. Bei Wartungsarbeiten außerhalb dieser Wartungszeiten werden dem Kunden Zeitpunkt, Dauer und Umfang der Arbeiten frühzeitig, nach Möglichkeit 10 Tage im Voraus mitgeteilt.
   • Sicherheit: Die „GLOBAL HEALTH HUB GERMANY“ Websites verwenden zur Datenverschlüsselung der Kommunikation eine SSL Verschlüsselung nach dem aktuellen Stand der Technik auf Basis eines vertrauenswürdigen öffentlichen Zertifikats. Alle technischen Komponenten der „GLOBAL HEALTH HUB GERMANY“ Websites befinden sich auf sicheren Servern vertrauenswürdiger Anbieter innerhalb der EU. Separate Firewalls sichern alle relevanten Komponenten auf den Servern. Die Aufteilung auf verschiedene Anbieter und Server und eine damit verbundene Backup-Strategie gewährleistet höchste Datensicherheit
     
     
     11. Zusätzliche Bedingungen für die Nutzung des „GLOBAL HEALTH HUB GERMANY“ e-Konferenzzentrums
     

     Das e-Konferenzzentrum ergänzt das Kommunikationsangebot des sozialen Netzwerks „GLOBAL HEALTH HUB GERMANY“, um frei buchbare Online-Meeting-Räume. Registrierte „GLOBAL HEALTH HUB GERMANY“ Nutzer können jederzeit Vortragsveranstaltungen (Webinare), Schulungen oder Projektbesprechungen im e-Konferenzzentrum organisieren und durchführen. Die Teilnehmer eines Online-Meetings müssen nicht auf dem „GLOBAL HEALTH HUB GERMANY“ registriert sein. Lediglich der Initiator/Organisator des Online-Meetings muss auf dem „GLOBAL HEALTH HUB GERMANY“ registriert sein.

     Die Online-Meeting-Räume werden kostenfrei für alle Akteure zur Verfügung gestellt. Die Nutzung der Räume ist an die Bedingung gebunden, dass vorranging Themen behandelt werden, die im Kontext des Gesundheitssektors stehen.

     „GLOBAL HEALTH HUB GERMANY“ behält sich vor, bei eindeutigem Missbrauch der Nutzungsbedingungen den Zugang zum e-Konferenzzentrum für den entsprechenden Nutzer zu sperren.

     Des Weiteren behält sich „GLOBAL HEALTH HUB GERMANY“ vor, die Anzahl an zur Verfügung stehenden Online-Meeting-Räumen jederzeit zu reduzieren. Die zuvor genannten Änderungen unterliegen der unter Punkt 5 genannten Fristen und werden dem Nutzer rechtzeitig kommuniziert.

     Diese zusätzlichen Bedingungen für die Nutzung des e-Konferenzzentrums ergänzen die Allgemeinen Bedingungen für die Nutzung des Dienstes „GLOBAL HEALTH HUB GERMANY“.

     Im Übrigen gelten die Regelungen der Allgemeinen Bedingungen für die Nutzung des Dienstes „GLOBAL HEALTH HUB GERMANY“.

Die unter dem Menüpunkt „Veranstaltungen“ angezeigten Bilder sowie die aus anderen Bereichen des Hubs angezeigten Bilder werden dynamisch aufgerufen. Diese Bilder werden von den Nutzern des Hubs eingestellt. Die Nutzer sind verpflichtet, die Nutzungsbedingungen der von ihnen hochgeladen Bilder zu beachten und haften bei Verstoß gegen vorliegende Bildrechte persönlich. Die Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH (Koordinator des GLOBAL HEALTH HUB) übernimmt keine Haftung für Bilder, die von den Nutzern hochgeladen wurden.
